You may face several penalties if convicted of driving while intoxicated (DWI) in New York, such as jail time, fines, probation, car impoundment, and the loss of driving privileges. In some cases, you may be sentenced to have a New York DWI ignition interlock device installed in your vehicle.

An ignition interlock device is a small machine that is typically installed in the glove compartment on the passenger’s side of your vehicle and wired into the vehicle’s ignition system.

Before you can drive, you must blow around 1.5 liters of air into the alcohol sensor unit, which may be mounted on the dashboard. If your blood alcohol content (BAC) is over a specific limit (typically .02% to .04%), the ignition interlock device will not let the vehicle start.

Some devices also require you to take “rolling tests.” These tests occur at random intervals once you are driving. If you do not take the rolling test or your BAC is over the preset limit, your horn may sound or your lights may flash until you turn the vehicle off. This rolling test is designed to prevent you from having a sober friend start the vehicle for you. It also deters drivers from drinking once the ignition has been started.

The ignition interlock device is designed to prevent tampering. Some devices may require you to hum while you blow into the device to prove that you are a human and not an air machine. If you try to physically tamper with the device, the attempt will be recorded in the device’s database.

You are required to take your vehicle in monthly for maintenance. During this time, data logs from the tests may be downloaded. These data logs contain information on all passing and failing test results. They will also show if you failed to take a rolling test.

The costs for an ignition interlock device, which include installation and monthly rental fees, must be paid for out of pocket. Installation typically costs $100 to $200, while rental fees can cost $70 to $100.
